YouTube giveaway rules: the pre-launch checklist

Why compliance matters: the risks of illegal YouTube contests

Running a giveaway on YouTube is subject to strict platform terms of service as well as national consumer protection laws (like the US FTC guidelines and UK ASA rules).

Violating these rules can lead to:

Before launching any contest on your channel, run through this pre-launch compliance checklist to ensure your channel stays protected.

YouTube's official contest Guidelines: what you MUST include

From YouTube's contest policies and guidelines, the requirements are:

  1. Your contest must be free to enter.
  2. You must not manipulate metrics on YouTube to misrepresent genuine viewer engagement.
  3. You must not associate or affiliate YouTube with your contest without written consent.
  4. Your official rules must link the YouTube Community Guidelines and state that non-compliant entries are disqualified.
  5. Your rules must state that YouTube is not a sponsor and require entrants to release YouTube from liability.
  6. Your rules must include a legally compliant privacy notice covering personal data you collect.
  7. You must comply with all applicable laws, and you remain solely responsible for the contest.

Worth noting what is not there. The policy contains no line saying "you may not require a like or a subscribe". What it contains is the metric-manipulation prohibition, which is the language that makes subscribe-to-enter a bad idea, since a subscription bought with a prize is not genuine engagement in any ordinary sense. That is an inference, a widely shared one, and you should know it is an inference rather than a quotation.

How to automate rules distribution and lead capture with ReplyTide

Putting huge blocks of legal text in your YouTube description often clutters your video metadata.

By integrating ReplyTide, you can streamline the process:

  1. Create a clean giveaway landing page hosting your full terms, privacy policy, and entry form.
  2. In your video, tell viewers: "Comment 'RULES' or 'GIVEAWAY' below, and our system will instantly send you the official rules and entry link!"
  3. ReplyTide automatically delivers the link 24/7, keeping your comment section organized and capturing verified email leads.

Where to put the rules

A block that size in the video description crowds out everything else, including the parts that help the video get found. The usual fix is a page you control holding the full rules and privacy notice, with a short pointer in the description.

Which raises the practical problem: not everyone reads descriptions, and "where are the rules?" becomes the most-asked comment of the contest. Announcing a word that returns the rules link handles it, and the same link stays in the description so nobody has to comment to reach it. Entry stays free either way, which keeps requirement 1 intact.

When entries close, the free comment picker draws from the thread with deduplication and a published seed, so the result is reproducible. Proving the draw was fair covers the announcement itself.

Common questions

Can I ask viewers to like and share to enter?

Asking is fine. Requiring is the problem: YouTube's contest policy prohibits manipulating metrics to misrepresent genuine viewer engagement, and a like given only to enter a draw is what that describes. Invite rather than require.

Are worldwide giveaways legally allowed on YouTube?

Giveaways open worldwide are common, but they must comply with local sweepstakes laws in every eligible country. Many creators restrict entries to specific regions (e.g. US/Canada/UK) to simplify tax and customs compliance.

What happens if the winner never responds?

If your published rules set a response window, a redraw is you following a rule rather than making an exception. That distinction is the whole reason to write item 10 before launch: without it, the most suspicious possible event, the winner changing after the fact, happens with no rule to point at.

Draw a winner people can verify. The free comment picker publishes a seed, so anyone can reproduce the draw.
